Abstract
Because of the influence of the disadvantageous changeing lobal labor situation and enterprise ownership structure, the supply exceeding demand in the labor market of our country and the structure contradiction of supply and demand,
the rights that the employees of our country enjoy at present are at a low level and the protection of employee rights has the characteristics of hierarchy,difference and complexity.To strengthen the protection of employee rights, it is necessary to construct a new labor relation that is fit for the inherent need of socialist market economy, clarify the basic principles for the protection of employee rights, further perfect the labor law system of our country and the effective mechanism for the protection of employee rights, exert the leading function of the government and the positive function of the labour union and employers and balance the power and rights of the two sides of labor and management
